Terms and Conditions

Page title: Terms and Conditions · Shopify slug: terms-of-service
1. Scope
(1) These Terms and Conditions ("Terms") establish the basis for every order placed through the online shop at avenor.com between the operator of avenor.com (hereinafter "AVENOR", "we", "us") and the customer (hereinafter "you", "Customer"). Our range encompasses goods in the home and garden categories.
(2) A consumer within the meaning of these Terms is any natural person who concludes a legal transaction for purposes that are predominantly unconnected to any trade or self-employed professional activity. A business customer is any natural or legal person, or partnership with legal capacity, acting in the exercise of their commercial or independent professional capacity when the contract is formed.
(3) Any deviating, conflicting or supplementary general conditions advanced by the Customer shall only be incorporated into the agreement where their applicability has been expressly confirmed by us in writing.
2. Contracting Party and Contact
The purchase contract is concluded between you and the operator of AVENOR. Full provider details are available on our Legal Notice page.
Customer support: contact@avenor.com
3. Conclusion of Contract
(1) The presentation of our home and garden goods in the online shop does not represent a legally binding offer; it serves solely as a non-binding online catalogue.
(2) By clicking the "Buy" / "Place order" / "Pay now" button, you submit a binding offer to purchase the items held in your shopping basket.
(3) Acknowledgement of receipt and acceptance of your order are sent simultaneously — you will receive both immediately after submitting your order by means of an automatically generated email. Upon despatch of that confirmation email, the purchase contract becomes legally binding.
(4) We retain the contract text and send it to you together with these Terms by email. The Terms currently in force can be consulted at any time at avenor.com/terms-of-service.
(5) Contracts are concluded in the English language.
4. Prices and Shipping Costs
(1) All prices shown on the website are inclusive of the applicable statutory Value Added Tax. Any delivery charges are displayed separately during the checkout process.
(2) For shipments to countries outside the European Union and the United Kingdom, customs duties, local taxes and further levies may apply; these are the sole responsibility of the Customer.
(3) Full details of delivery charges and estimated shipping windows are provided on our Shipping & Payment page.
5. Payment Terms
(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, Apple Pay, Google Pay and bank transfer. We reserve the right to exclude individual methods in specific circumstances.
(2) The full purchase price is due upon conclusion of the contract.
(3) Where payment is made by credit card or PayPal, your account will be charged immediately upon completion of the order.
6. Delivery
(1) Goods are sent to the delivery address provided by the Customer. The applicable delivery windows are shown on each product page and throughout the checkout process.
(2) Should delivery remain impossible after three attempts, we are entitled to withdraw from the contract. Any amounts already received will be refunded without delay.
(3) Where force majeure causes a delay, the delivery period will be extended proportionately. We will inform you of any such development as promptly as possible.
7. Retention of Title
All goods delivered remain our property until the full purchase price has been received.
8. Right of Cancellation for Consumers
Consumers are entitled to a statutory right of withdrawal. Full cancellation details and the model withdrawal form are available on our Cancellation Policy page.
9. Warranty and Liability for Defects
(1) The statutory provisions on defect liability apply. For consumers, the limitation period for defect-related claims is two years from the date of delivery.
(2) For second-hand goods, this period is reduced to one year from the delivery date.
(3) Should any delivered item arrive with a defect, please contact us at contact@avenor.com.
10. Liability
(1) We accept unlimited liability in cases of intent and gross negligence, and within the framework of applicable consumer protection legislation.
(2) In cases of ordinary negligence, our liability is limited to breach of a fundamental contractual obligation — one whose fulfilment is essential to the proper execution of the contract and upon which the Customer may reasonably rely. In such instances, liability is capped at foreseeable, contract-typical loss.
(3) Liability for injury to life, limb or health is not affected by the foregoing.
11. Dispute Resolution
(1) The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
12. Applicable Law and Jurisdiction
(1) The contractual relationship is governed exclusively by the laws of England and Wales, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as the protection conferred by mandatory provisions of the consumer's country of habitual residence is not thereby withdrawn.
(2) Where the Customer is a merchant, a body corporate under public law or a public-law special fund, the courts at our registered office shall have exclusive jurisdiction over all disputes arising from this relationship.
13. Final Provisions
Should any provision of these Terms be or become wholly or partially void, the validity of the remaining clauses shall not be affected. The relevant statutory rule shall substitute any invalid provision.
